This lawsuit concerns the management fees that Farmers Group Inc. charged
for managing certain operations of the Farmers insurance exchanges,
known as Farmers Insurance Exchange, Fire Insurance Exchange, and Truck
Insurance Exchange. The Exchanges paid those fees to Farmers Group Inc.
out of the premiums that the Exchanges charged to their customers. The
lawsuit claims that the management fees were too high and that Farmers
Group Inc. made too much in profits, purportedly in violation of California
law. The Defendants dispute these claims. The Defendants claim that
Farmers Group Inc. behaved appropriately at all times and that its management
fees and profits were and are reasonable.
The Court has not decided in favor of the Plaintiff or the Defendants.
Instead, the Plaintiff and the Defendants agreed to a Settlement. That
way, both sides avoid the cost and risks of a trial, and the Class Members
will get the benefits of this Settlement. The Class Representative and
his attorneys, who conducted an extensive investigation of the facts
and the law relevant to the lawsuit, think the Settlement is best for
all Class Members.
You are a Class Member if you were a subscriber to, or a named insured
on an insurance or reinsurance policy issued by Farmers Insurance Exchange,
Fire Insurance Exchange, or Truck Insurance Exchange at any time from
January 1, 1999, through December 31, 2010. The Class in this lawsuit
does not include insureds of any other insurance companies operating
under the Farmers Insurance Group of Companies service mark.
